A man accused of shouting an anti-national slogan

The Madhya Pradesh High Court recently granted bail to a man named Faizal, who was accused of shouting anti-national slogans, specifically “Pakistan Zindabad” and “Hindustan Murdabad.” This decision, made by Justice Dinesh Kumar Paliwal, came with a unique condition aimed at instilling a sense of patriotism in the accused. Faizal is required to salute the Indian national flag and chant “Bharat Mata Ki Jai” a total of 21 times during each session at a police station in Bhopal, specifically on the first and fourth Tuesdays of each month until his trial concludes.


Faizal was taken into custody on May 17 after allegedly making these inflammatory statements in public, leading to charges under Section 153B of the Indian Penal Code for promoting enmity between different groups and disrupting public harmony. His defense argued that he had been falsely implicated and emphasized his cooperation with authorities. However, the prosecution pointed to Faizal’s criminal history, which includes 13 previous cases, suggesting that his actions were intended to provoke and threaten national harmony. The state’s counsel remarked that if Faizal was dissatisfied with India, he could choose to live elsewhere, indicating a lack of respect for his country.


In granting bail, Justice Paliwal acknowledged Faizal’s criminal background but opted for a compromise that would encourage a sense of responsibility and national pride. The court’s order emphasized that the conditions imposed were designed to foster respect for the nation in which Faizal was born and resides. The police commissioner in Bhopal has been tasked with ensuring compliance with these stipulations.


This ruling has sparked discussions about the intersection of law, patriotism, and individual rights. While some view the conditions as an innovative approach to instill national pride, others raise concerns about the implications of such mandates on personal freedoms and the judicial system’s role in enforcing patriotic sentiments. As Faizal prepares to fulfill these requirements, it remains uncertain whether this experience will lead to a genuine change in his perspective or merely serve as a legal formality.
